These Terms and Conditions apply to your use of the website located at https://theuteshop.com.au and to purchases of products and services from The Ute Shop Pty Ltd ATF The Ute Shop Trust (ACN 153 583 601), trading as The Ute Shop (we, us or our).

1. Acceptance of these terms

By browsing this website, making an enquiry, placing an order, booking workshop work or otherwise engaging with us, you agree to these Terms. If you place an order on behalf of a company or another person, you confirm that you are authorised to bind that company or person to these Terms.

You must provide information that is accurate, current and complete. You must be at least 18 years old or have the authority of a parent or legal guardian to place an order or book work with us.

2. Our products and services

The Ute Shop supplies 4WD and ute accessories, vehicle-specific products and related workshop services. Products and services may include, for example, suspension, GVM-related products, barwork, canopies, trays, towing equipment, electrical and 12V systems, storage, recovery equipment, lighting and touring accessories.

Product photographs, specifications, availability, prices, fitment information and descriptions on the website are provided as a guide. We take reasonable care in preparing them, but the final suitability of a product, compatibility with a vehicle and availability of stock must be confirmed before purchase or installation.

Some goods are vehicle-specific, special order, made to order, imported, customised or intended to be fitted as part of a larger build. These goods may have additional lead times, deposit requirements, cancellation limits, fitting conditions or manufacturer requirements. We will advise you of material conditions that apply to your order before accepting it where reasonably practicable.

3. Vehicle information and fitment

Many products depend on the precise vehicle make, model, variant, year, drivetrain, specification and existing modifications. Before placing an order or authorising installation, you must provide accurate vehicle information and disclose relevant changes to the vehicle, including prior modifications, accessories, suspension changes, towing equipment, electrical systems and damage that may affect fitment.

Website filters, fitment tools and product descriptions are helpful starting points, but they are not a substitute for confirmation by The Ute Shop. We may ask for further information, photographs, a VIN, measurements or an inspection before we confirm fitment. Do not rely on a product being suitable simply because it appears in a category or search result.

Where a product requires professional installation, certification, calibration, software coding or compliance work, we may decline to supply or install it until the applicable requirements have been considered. Nothing in these Terms is a statement that a product will increase a vehicle’s legal load rating, towing capacity, GVM, GCM or registration status.

4. Quotes, orders and deposits

A quote is an invitation to treat and is not a binding commitment by us to supply the relevant goods or services. A quote may state a validity period; if it does not, it may be withdrawn or revised if stock, freight, exchange rates, supplier pricing, product availability or the scope of work changes.

An order is accepted when we issue a written order confirmation, accept payment or deposit, commence the work, or otherwise confirm acceptance in writing. We may decline or cancel an order before acceptance where there is an obvious pricing error, incorrect product information, stock unavailability, suspected fraud, a fitment issue, or another reasonable operational reason. If we cancel an order before supply, we will refund any amount paid for the unavailable or cancelled goods, subject to any separately agreed special-order terms.

We may require a deposit for workshop bookings, special-order products, custom fabrication, trays, canopies, vehicle builds or other goods that are not standard shelf stock. The amount, payment timing and cancellation conditions for a deposit will be advised at the time of the order or booking.

5. Price and payment

Unless otherwise stated, prices on the website are in Australian dollars and include GST. Delivery, freight, fitting, certification, programming, additional hardware and other charges may be additional where shown at checkout, in a quote or in an order confirmation.

You must pay all amounts due by the agreed due date. We may delay dispatch, collection, fitting or completion of work until cleared funds are received. We may use third-party payment providers to process payments. Their own terms and privacy policies may also apply.

If an obvious price, description or calculation error is identified, we may correct the error and contact you before dispatch or installation. If you do not wish to proceed at the corrected price or on the corrected terms, you may cancel the affected order and receive a refund of amounts paid for that affected order.

6. Workshop bookings and vehicle work

If you book your vehicle for inspection, fitment, installation or other workshop work, you must deliver the vehicle at the agreed time in a safe, roadworthy and reasonably clean condition. Please remove valuables and personal belongings before leaving the vehicle with us.

The scope of work will be set out in a quote, job card, booking confirmation or other written communication. If we identify additional work, unforeseen issues, damaged parts, non-standard modifications or safety concerns that may affect the agreed scope, we will contact you where reasonably practicable before carrying out chargeable additional work.

Completion times are estimates only unless we expressly agree otherwise in writing. Delays can occur because of supplier availability, freight, parts, vehicle condition, hidden defects, weather, third-party certification requirements or other matters outside our reasonable control. We will keep you reasonably informed of material delays.

7. Delivery, freight and collection

Delivery options, charges and timeframes will be shown at checkout, in a quote or in an order confirmation. Delivery dates are estimates, not guarantees, unless we expressly agree otherwise in writing.

If goods are delivered by a third-party carrier, the carrier’s conditions may apply. You must inspect goods as soon as reasonably practicable after delivery and tell us promptly if goods are damaged, incorrect or missing. This does not limit any rights you may have under the Australian Consumer Law.

If you collect goods from our Warana premises, collection must occur during agreed hours and after we confirm that the order is ready. We may require reasonable identification or proof of authority before releasing an order.

8. Returns, cancellations and consumer guarantees

Our separate Returns Policy explains how we handle change-of-mind returns, incorrect items, faulty goods and warranty enquiries. It forms part of these Terms.

Nothing in these Terms or our Returns Policy excludes, restricts or modifies rights that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law. Where the Australian Consumer Law applies, you may be entitled to a repair, replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage. You may also be entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

For change-of-mind returns, custom goods, fitted goods, special-order goods, items modified after supply, clearance goods and freight costs, the applicable conditions will be set out in our Returns Policy and any written special-order terms. 9. Warranty claims

Some products are supplied with a manufacturer warranty. The warranty period, conditions, exclusions and claim process are determined by the relevant manufacturer, in addition to rights that you may have under Australian Consumer Law.

To help us assess a claim, we may ask for proof of purchase, photographs, a description of the issue, fitment details, vehicle information, inspection access and any documentation required by the manufacturer. Do not arrange unauthorised repairs, modifications or disposal of the product before giving us a reasonable opportunity to assess the issue, unless doing so is necessary for safety or required by law.

10. Website use and intellectual property

The website and its content, including text, photographs, product layouts, graphics, logos, branding, video, design and software, are owned by or licensed to The Ute Shop unless otherwise stated. You may view and use the website for personal, lawful and non-commercial purposes.

You must not copy, reproduce, distribute, scrape, sell, reverse engineer, interfere with, misuse or exploit website content without our prior written permission, except where permitted by law. Vehicle manufacturer names, model names, marks and logos may be used on our website for identification and compatibility purposes; they remain the property of their respective owners.

11. Links and third-party services

The website may link to third-party websites, services, products, payment providers, manufacturers, couriers or social-media platforms. We do not control those third parties and are not responsible for their content, availability, policies or acts. Your use of third-party services is subject to the relevant third party’s terms and privacy policy.

12. Liability

To the extent permitted by law, we exclude liability for indirect, incidental, special or consequential loss, loss of profits, loss of opportunity, loss of data or loss arising from a failure to provide accurate vehicle or order information. This clause does not exclude any liability that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Where permitted by law and where a liability cannot otherwise be excluded, our liability may be limited, at our option, to resupplying the relevant goods or services, paying the cost of resupply, repairing the goods, replacing the goods or paying the cost of replacement.

13. Privacy

We collect, hold and use personal information in accordance with our Privacy Policy. By providing personal information to us, you consent to our handling of that information as described in that policy and as otherwise permitted or required by law.

14. Changes to these Terms

We may update these Terms from time to time. The current version will be published on our website with its effective date. Terms that applied when you placed an accepted order or made a booking will continue to apply to that order or booking, unless we agree otherwise or law requires a change.

15. Governing law and contact

These Terms are governed by the laws of Queensland, Australia. Any dispute will be subject to the courts and tribunals of Queensland and Australia, subject to any applicable consumer-law rights.
